According to this schedule, Joint Rulemaking is slated for late 2026 through 2027, with Full Implementation scheduled for early 2027. This means the countdown is officially underway for XRP holders and cryptocurrency exchanges.
The Timeline and What it Shows
The legislative process tracked in SMQKE’s timeline begins with Senate Committee Markup, initially scheduled for mid-March 2026, and extends through full compliance. The projection indicates that a Full Senate Vote would have sent the legislation to the President’s desk by April or May 2026.
A Presidential Signing in June 2026 was projected to initiate a Provisional Registration window, allowing exchanges to register with the CFTC and steer clear of enforcement actions. The two most critical milestones are highlighted in specific rows.
The Joint Rulemaking Period, mapped out for late 2026 into 2027, mandates that the SEC and CFTC establish final joint regulations regarding custody and token classification. Full Implementation in early 2027 concludes an 18-month grace period, after which complete compliance becomes mandatory for all platforms.

The CLARITY Act’s Collapse Changed the Path
The timeline published by SMQKE was built on the premise of legislative success. However, the CLARITY Act failed a Senate cloture vote on September 15, missing the 60-vote threshold by 11 votes as every present Democrat voted against it.
Despite the bill’s defeat, regulators pressed forward. SEC Chair Paul Atkins announced that the commission would continue operating within its existing statutory authority, and the CFTC adopted the same stance. Both bodies took action within days of the vote.
On September 17, the SEC rolled out the Innovation Exemption, launching a 5-year conditional framework for trading tokenized stocks. Simultaneously, the CFTC issued a no-action position benefiting passive software providers. Shortly after, on October 1, the SEC put forward a proposed crypto custody rule directed at investment advisers.
Instead of relying on a statute, the regulatory agencies are constructing the framework through guidance, proposals, and exemptions. The ultimate destination remains unchanged, even though the route has shifted.

Under a joint interpretation finalized by the SEC and CFTC in March 2026, XRP is categorized as one of 16 digital commodities. The upcoming Joint Rulemaking Period will dictate how token classification policies are applied and how custody mandates are enforced.
